Teen Relationships need Sensitivity, not mechanical Criminal action: HC on consensual minor cases

Recently, the Uttarakhand High Court stayed proceedings before the Juvenile Justice Board in a case involving two minors, emphasising that cases stemming from consensual relationships between adolescents demand a cautious and balanced judicial approach. The Court emphasised the need to reconcile child protection laws with the evolving realities of adolescent relationships.

The case originated from a complaint filed by the girl’s father alleging abduction, leading to registration of an FIR and subsequent chargesheet against the boy, both aged around 15. However, the defence presented a contrasting narrative, highlighting that the minors had known each other for several years and shared a close bond. It was pointed out that while the girl initially denied any physical relationship, she later acknowledged before the magistrate that the relationship was voluntary. The defence further relied on her statement indicating that she had invited the boy to her home and interacted with him willingly, alongside medical findings that did not suggest any force or coercion. Concerns were also raised about the adverse impact of continued detention on the boy’s future.

Justice Alok Mehra observed that such matters cannot be approached mechanically and require a sensitive judicial lens, particularly where both individuals are minors. Stressing the importance of contextual evaluation, the Court noted that “cases arising from consensual relationships between minors must be dealt with carefully,” adding that the girl’s statement and the age of the parties are pivotal considerations. The Court signalled that rigid application of criminal law may not always serve the ends of justice in such situations.

Consequently, it stayed further proceedings before the Juvenile Justice Board and issued notice in the matter.
