Uttam Nagar Holi Lynching: Supreme Court directs Tarun Butolia's family to seek security from Delhi Police Commissioner

The Supreme Court declined to order a CBI investigation into the Holi lynching death of 27 year old Tarun Butolia in Uttam Nagar, Delhi, instead directing his family's representatives to approach the Delhi Police Commissioner with a comprehensive representation on their security concerns, while keeping the High Court door open if those concerns go unaddressed.

The controversy began on March 4, 2026, when a water balloon dispute between neighbouring Hindu and Muslim families in Uttam Nagar escalated into a violent clash that claimed Tarun's life and left several others injured. His family's representatives, Advocates Hari Shankar Jain, Ashish Kumar Dwivedi, Harinandan Singh, and Yogesh Kumar, approached the Supreme Court seeking a CBI probe and protective measures for the victim's family, citing the communally charged nature of the incident and invoking the Supreme Court's own guidelines in the Tehseen Poonawalla case on remedial measures for lynching victims' families.

The petitioners argued that given the circumstances, the family faced a credible threat and required institutional protection that only a Court-monitored mechanism could guarantee.

A bench of CJI Surya Kant, Justice Joymalya Bagchi, and Justice Vipul Pancholi was unreceptive to the CBI demand, with CJI Kant observing that the agency's hands were already full and cautioning against demoralising professional police forces with blanket distrust. When the petitioners clarified they were no longer pressing for a CBI probe but focused solely on the family's safety, the Court found a workable middle path.

Quoting from the order, the bench noted, "There is no gain saying that the police authorities will evaluate the threat perception and will take remedial measures as may be required." 

The Court granted liberty to the petitioners to submit a comprehensive representation to the Commissioner of Police, Delhi, and made clear that if their grievances remained unresolved, the Delhi High Court would be the appropriate next forum.
