Supreme Court calls out ‘Systemic Discrimination’ in Denial of Permanent Commission to Women Armed Forces Officers

The Supreme Court has held that systemic discrimination within the armed forces led to denial of Permanent Commission (PC) to several women officers in the Army, Navy, and Air Force, granting sweeping relief including pension benefits and protection of existing commissions. The ruling is significant as it confronts entrenched institutional bias and reshapes how women’s careers in the armed forces are assessed.

The case arose from a batch of petitions filed by women officers serving under Short Service Commission (SSC), who challenged the denial of Permanent Commission despite years of service. While the Union defended its policy framework, arguing that grant of PC was governed by service requirements and evaluation criteria, the petitioners contended that the implementation of policies, particularly post-2019, was exclusionary and failed to provide them a fair opportunity for career advancement.

Many officers had already been released from service after completing their tenure, without being meaningfully assessed for long-term roles, despite earlier judicial recognition of their entitlement to be considered for PC.

The Court found that evaluation processes were tainted by preconceived notions about women’s suitability for long-term service, adversely impacting their merit and career progression. It observed, “The inequality of opportunities has affected their inter se merit… denial of Permanent Commission was a consequence of systemic discrimination,” invoking its powers under Article 142 to do complete justice. The Bench held that criteria such as service length and newly introduced performance benchmarks were unfairly applied without giving officers a real chance to meet them.

While refraining from ordering reinstatement in certain cases due to operational considerations, the Court directed that affected officers be deemed to have completed 20 years of service for pension purposes, protected commissions already granted, and issued guidelines to ensure transparency and fairness in future selection processes.
