SC declines to Intervene in Runaway Couple plea, notes HC already seized of issue

On Monday, in a case that highlights the urgent safety concerns faced by runaway couples, the Supreme Court stepped back from direct intervention after noting that the Delhi High Court had already taken charge of the situation. With protective measures now underway at the High Court level, the Court chose to close the proceedings, signaling that immediate relief was already being addressed through the appropriate forum.

The case arose when the couple approached the Apex Court under Article 32 of the Constitution, alleging threats from the woman’s family after leaving their homes and relocating to Delhi. While the Court had earlier declined to grant direct protection, it directed the petitioners to approach the jurisdictional High Court. When the matter was taken up again, it was informed that the Delhi High Court had constituted a special bench, engaged with state authorities, and put in place interim measures, including police protection and counselling mechanisms aimed at addressing such recurring situations.

The Court observed that the matter was now actively being handled at the High Court level and did not warrant further intervention at this stage. It stated, “In this view of the matter, the petition is disposed of at this stage, with liberty to the petitioners or any other person to approach this Court at an appropriate stage.”

The Court accordingly allowed the petition to be withdrawn, expressing confidence that the High Court would adequately address both individual and systemic concerns.
