Right to Life: PIL in High Court for release of welfare funds to Advocates in need in wake of COVID-19 [Read Petition]

On Monday,  Advocates of the Rajasthan High Court has filed a PIL in the Court for thr release of welfare fund collected for Advocates in distress due the lockdown observed in wake of COVID-19 Global pandemic.

The petitioners through the PIL has nrought attention of the Court towards the hardship which are being faced by the legal
fraternity members of bar in the emergent situation of nationwide complete lock down due to outbreak of corona virus and badly disturbed functioning of the Judiciary which has caused the negative impact upon the bread and butter, livelihood of members of bar at large.

In wake of the same, the petitioners sought direction to release the fund for granting financial assistance to needy Advocates.

It was contended by the petitioners that statutory provision of law as well as rules has already been enacted to deal with the issue yet respondents failed to discharge its statutory obligation.

Therefore, by way of instant petition relief under the prayer clause is made so the needy advocate may be compensate for the loss of their livelihood and for the betterment of legal fraternity in the unprecedented times of global pandemic Covid-19.

The PIL states:

"The prevailing situation of complete lockdown majorly affected the younger/junior advocates who are now in the initial days of their career/profession and are depended on the daily earning whereas profession of advocacy is under the purview of self employment. Thus, in these terrible situation created financial crisis amonsgst\ the legal fraternity and put them on the verge of starvation which is against the Right to Life as bestowed by the Article 21 of the Constitution of India."

The grounds for PIL were:

1. Advocates been deprived of their sole source of income in quarantine period and on verge of starvation and finding it extremely difficult to sustain their lives and thus in dire need of financial assistance.

2.Under rules 40, 41, 42 , 43 44 , 44-A and 44-B of the Part-VI of the Bar Council of India Rules sufficient provisions had been made for creating a corpus of funds and for their distribution amonsgst\st advocates in times of need. 

3.Respondents are in the capacity of care taker and guardian of rights, privileges, interest, status of the whole lawyer community.
