Modi Govt turns down Election Commission's demand for Contempt Power

EC is hurt by the recent allegation of a partisian role made by the AAP.

Demand by Election Commission to get power to initiate the contempt proceedings against the political parties which make allegations against it without credible evidence has been rejected by Government, Rajya Sabha was informed.

P P Chaudhury, Minister of State for Law said in the written reply that EC proposal was examined from the legal and the constitutional angles.

He further added that,"It has been opined that conferment of power of contempt on Election Commission may be inconsistent with law laid down by Supreme Court".

Election Commission in its letter to the Law Ministry had stated to amend election laws so that it could use 'Contempt of Court' Act against such parties.

Letter came close on heels of AAP questioning impartiality of EC.

The EC had also pointed out that the several Election Management Bodies, including those in Kenya and Pakistan have direct powers to initiate the Contempt Proceedings.
