Homebuyers wearing Identical T-Shirts interrupt NCLT Hearing and force Adjournment

On Monday, the National Company Law Tribunal (NCLT) in New Delhi witnessed an unusual display of courtroom activism when multiple homebuyers of the stalled Ansal Fernhill housing project arrived wearing identical T-shirts, signalling their frustration over prolonged delays in the resolution process. The hearing, scheduled before Member (Judicial) Ashok Kumar Bhardwaj and Member (Technical) Reena Sinha Puri, saw abrupt tension as the Bench adjourned the matter to November 17 on a counsel’s request.

The Ansal Fernhill project, associated with Ansal Properties & Infrastructure Ltd (APIL), has remained entangled in legal proceedings for over a decade. Currently, the project is undergoing a corporate insolvency resolution process (CIRP). Several homebuyers, sporting T-shirts marked with folded-hand symbols, attended the Tribunal to press for progress, reflecting the growing impatience of stakeholders affected by the stalled development.

A connected issue concerns land owned by Samyak Projects. In a prior hearing in June, the NCLT had recognised this land as an integral part of the Fernhill development and directed that, “The Resolution Professional (RP) may seek expansion of the CIRP to Samyak if required and noted that Samyak would be entitled to a fair share of any additional price linked to the land.” Despite this, the RP reportedly encountered obstruction as Samyak allegedly restricted access to the land, leading to an application before the Tribunal.

Homebuyers vocally objected to the repeated adjournments, emphasizing the prolonged delay in resolution and its impact on their interests. The RP sought the Tribunal’s directions to ensure the inclusion of Samyak Projects’ land in the ongoing CIRP and to address alleged obstructions.

As proceedings unfolded on Monday, the Tribunal faced interruptions from homebuyers while dictating its order. The Bench observed the intensity of stakeholder frustration but did not deliver a detailed order in open court, choosing instead to rise abruptly without pronouncement. The events highlighted the tension between procedural conduct in CIRP matters and the urgent expectations of affected parties.

The matter has been adjourned to November 17
