The Allahabad High Court has granted the time period of two week to the State government to file counter affidavit against the petition filed before the Court for release of aged prisoners with comorbidities.
A Public Interest Litigation has been filed before the Allahabad High Court to make the jails less crowded by taking various effective measures considering the health of prisoners in critical situation where the number of Corona cases are increasing rapidly.
The Division Bench comprised of Justice Pritinkar Diwakar and Justice Subhash Chandra Sharma while hearing the Public Interest Litigation, issued notice to the state government for filing its reply with in two week.
A public interest litigation has been filed by senior advocate Dilip Kumar for the petitioner Manmohan Mishra wherein he has sought directions to the Prison Administration Department, Government of Uttar Pradesh and Uttar Pradesh High Powered Committee.
The petitioner in his petition has requested before the court to consider the release of prisoners who are over 65 years old or who are suffering from other diseases as per the guidelines issued by the Ministry of Home Affairs on 29 July. To make this effective, the court should ensure speedy trial and disposal of bail applications, parole applications, etc.
The petitioner has stated before the court that congested jails invite mass infection and there is no medicine to combat the virus.
The court has listed the present matter on 14th October for next hearing.
