The Allahabad High Court has expressed its concern over the misuse of the cow slaughter law in the state of UP and the poor condition of caring for the released animals. Act is being misused against innocent persons.
Whenever any meat is recovered, it is normally shown as cow meat (beef) without getting it examined or analysed by the Forensic Laboratory. In most of the cases, meat is not sent for analysis. Accused persons continue in jail for an offence that may not have been committed at all and which is tribal by Magistrate Ist Class, having maximum sentence up to 7 years.
This was stated by Justice Siddhartha in his order after hearing the bail application of Ramu alias Rahimuddin jailed under the Govdh Act. The court, while granting bail to the petitioner, ordered him to be released after completing the prescribed procedure.
Applicant/Ramu's bail application stated that there was no specific allegation against the petitioner in the FIR nor he was arrested from the spot. Apart from this, the police also made no attempt to know the reality of the recovered meat whether it was cow meat or any other animal.
Considering the material on record, the court has granted the bail application on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned and subject to the conditions for bail as prescribed by court.
The court also expressed its concern over the poor condition of released animals and said that whenever cows are shown to be recovered, no proper recovery memo is prepared and one does not know where cows go after recovery. Goshalas do not accept the non-milking cows or old cows and they are left to wander on the roads.
The court said that there is a need to implement the cow slaughter act in the state with the right spirit.
