HC directs Kurukshetra University & Haryana Education Department to give decision in plea against conduct of semester exams from July (Read Order)

In a Writ Petition filed against the decision of Kurukshetra University to conduct semester examination from July 1, 2020, the Punjab and Haryana High Court, without making any observation on merits of the case, directed the University and Department of Education, Haryana, to dispose of the matter with seven of such representation (to be made) by the petitioner. 

Factual Background

Three petitions were preferred before the Court, wherein, a notification dated May 21, 2020, issued by Kurukshetra University for conducting semester examination from July 1, 2020, was challenged. Owing to similarities of facts and matter in issues, the Court decided the petitions together.

Case of the Petitioner

The learned Counsel for the petitioner argued his case for some time, after which he sought Court’s plea to withdraw his petition with liberty to approach Kurukshetra University and Department of Education, Government of Haryana, to get their grievance redressed. Given the fact that exams are scheduled to start within three weeks, the petitioner further sought a direction from the Court for disposal of their representation before the University and the Education Department, Haryana in a time bound manner.

Response of the State Counsel

The Learned Counsel for the State submitted that the representation to be filed by the petitioner before University or Education Department would be disposed of by passing a speaking order addressing their grievance with ‘seven days’ of their representation and the decision so taken would be conveyed to the representation maker on the address mentioned in the representation.

Decision of the Court

The Court without expressing any opinion on merit of the case, held that the Education Department and the University “will be bound” by the statement made by state Counsel regarding disposal of representation (to be made) in a time bound manner.
