When a consumer approached the Consumer Commission in respect of defective washing machine, by an order dated 6 October 2015, the District Consumer Disputes Redressal Forum directed the petitioners to take possession of the washing machine which was sold to the respondent from his residence and after carrying out repairs to return it to the respondent free from all defects within a stipulated period. The dispute in execution arose from the order of the District Forum. When the matter reached to the State Commission, it opined that the District Forum should proceed against the petitioners herein for non-compliance of its order in pursuance of which a warrant of arrest was issued on 16 September 2019. Matter finally reached the Supreme Court.
Supreme Court in the case titled as HAIER APPLIANCES (INDIA) PVT. LTD. & ANR. vs SOMENATH BASU on 10.02.2020 has observe as under:
"When the present Special Leave Petition came up before this Court on 18 November 2019, counsel for the petitioners undertook to replace the washing machine with a new one to the respondent.
An affidavit of compliance was directed to be filed. In pursuance of the order, an affidavit of compliance has been filed on 9 December 2019 stating that the old washing machine of the respondent has been replaced with a new updated model on 2 December 2019.
Since the order of this Court has been complied with, we now close all proceedings arising out of the order of the District Forum. The warrant of arrest dated 16 September 2019 shall stand quashed and set aside and the execution proceedings shall stand closed".
