Is Bar Council justified in objecting Phoolka's appearance as Advocate while holding Office of Profit

H S Phoolka has said that,"One thing is clear to me that I shall not give up these cases.  I shall resign from post of the Leader of Opposition as these cases are my first priority".

Leader of Opposition in Punjab Assembly Advocate H S Phoolka has made it clear that if Bar Council of Delhi doesn't permit him to appear in cases of 1984 victims, which he was fighting free, even after giving up his status of Minister, he would resign from post of the Leader of Opposition also.

He has even conveyed it to AAP Convener Arvind Kejriwal.

Phoolka tweeted  that,"Will not give up '84 carnage cases. Asking the Bar Council if by giving up the Minister status, I can appear in these cases".

Phoolka has stated that he would be asking Bar Council if he could appear in these cases after giving up his minister status (that is giving up pays and perks associated with Status) but retaining post of Leader of the Opposition.

Hearing of these cases resumed on July 4 and in this month alone there would be 11 hearings in these cases.

Phoolka had earlier written to the Delhi Bar Council that he had suspended his practice after becoming the Leader of Opposition but he should be allowed to appear in cases of the victims of the 1984 massacre of the Sikhs as he was fighting these cases free from very beginning.
A Minister gets a salary and perks of around Rs 2 lakh and this is considered as full-time employment as the Minister holds an executive post.
