A Husband's duty of Maintenance does not cease at Death but devolves upon His Father: HC Clarifies the continuing operation of S.19 of the Hindu Adoptions And Maintenance Act

Recently,  the Allahabad High Court has held that a woman’s right to maintenance does not end with the death of her husband and can be enforced against the father-in-law. The Court dismissed an appeal challenging such a claim, clarifying that statutory protection under the Hindu Adoptions and Maintenance Act continues to operate even after the husband’s demise, strengthening safeguards for dependent widows.

The case arose from a dispute where a widow sought maintenance after being left without adequate means following her husband’s death. The Appellant contested the claim, arguing that the obligation ceased with the husband’s passing. However, the legal framework under Section 19 of the Hindu Adoptions and Maintenance Act, 1956, became central to the dispute, which permits a widowed daughter-in-law to seek support from her father-in-law if she cannot sustain herself through her own income, property, or other familial sources. The matter thus turned on whether this statutory obligation could extend beyond the lifetime of the husband.

The Court rejected the appellant’s contention and emphasised the continuing nature of the husband’s duty. It observed, “it is well settled that a husband is obliged to maintain his wife… this obligation… attaches even after his death as the law allows the widow to claim maintenance from her father-in-law.” The Bench clarified that this right is not absolute but conditional, arising only when the widow lacks independent means and is subject to the financial capacity of the father-in-law from ancestral or coparcenary property.

Consequently, the Court upheld the widow’s entitlement and dismissed the appeal.
