Rowdy strikes Amazon for Counterfeiting!

The Telugu Cinema superstar Vijay Deverakonda had approached the Civil Court Bangalore claiming that counterfeit products of his brand ‘Rowdywear Pvt. Ltd.’ were listed and were being sold on the e-commerce giant Amazon’s website.

Rowdywear Pvt. Ltd. owns the mark ‘Rowdy’; however, a brand called ‘Generic’ was selling counterfeit products especially T-Shirts bearing Rowdywear Pvt. Ltd.’ s marks on amazon.in. Such sale of counterfeit products directly infringed upon Rowdywear Pvt. Ltd.’s rights in retaliation to which Vijay Deverakonda approached the Civil Court. Vijay Deverakonda claimed that all the styles and variants of their T-Shirts were being replicated by manufacturers based in Karnataka, Telangana and Andra Pradesh.

It was further stated in the suit that Vijay Deverakonda’s right to publicity and privacy were being violated as the packaging of the counterfeit products portrayed his pictures to boost the sale of the counterfeits and leverage from Vijay Deverakonda’s popularity.

On February 22, 2019, the Civil Court passed an interim order which will restrain Amazon from passing off the goods produced by Vijay Deverakonda’s brand ‘Rowdy’ as their own. This order ensures that Rowdywear Pvt. Ltd.’s marks are not infringed upon. The next date for the hearing will be March 29, 2019.
