Copyright Infringement: Motorola Solutions has sued the Same Company for the Third Time!

Motorola Solutions Inc. is an American data communications and telecommunications provider that succeeded Motorola Inc. announced on 19 December 2018 that Motorola Solutions filed a claim for Copyright infringement against Hytera Communications Australia and China. Hytera is a manufacturer of radio transceivers and radio systems, founded in China in 1993.

According to Motorola Solutions, “Hytera unlawfully copied Motorola Solutions’ MotoTRBO source code into Hytera’s Digital Mobile Radio (DMR) equipment, thereby infringing and continuing to infringe Motorola Solution’s Copyright in violation of Australian copyright laws.”

The case filed in the Federal Court alleges that some Hytera DMR sold locally, infringes three Motorola Solution’s patents.

Motorola Solutions is seeking damages along with an injunction which will prevents Hytera from importing or selling any product in Australia that uses the infringed source code, and also seeks additional relief if the court deems appropriate.

Motorola Solutions has previously filed complaints of Patent infringement and trade secret misappropriation against Hytera in the US District Court for the Northern District of Illinois on 14 March 2018 and a patent infringement complaint with the US International Trade Commission on 29 March 2018. Patent infringement complaints were also filed with the Regional Court of Dusseldorf in Germany on 18 April 2018 and with Regional Court of Mannheim in Germany on 24 July 2018.

Mark Hacker, general counsel, and chief administrative officer at Motorola Solutions said, “As evidenced by our recent victories at the US International Trade Commission and in Germany, Hytera is a serial infringer and copier that have cheated its way to the market.

We will not relent in holding Hytera accountable for its egregious and illegal behavior and protecting our intellectual property for the benefit of our customers, shareholders, employees, partners, and other stakeholders.
