Rajasthan High Court slams school for withholding student’s improvement exam form, terms conduct “Attempt to Spoil the Future”

The Rajasthan High Court has expressed strong disapproval of a school’s “casual approach” in failing to forward a student’s improvement examination form to the Central Board of Secondary Education (CBSE) despite receiving three reminders, calling it an “attempt to spoil the future and one year of the academic career” of the student.

Justice Anoop Kumar Dhand, disposing of the petition, noted that the school had already compensated the student with ₹1.10 lakh and that the petitioner had been allowed to appear in the repeat paper. The Court directed CBSE to declare the student’s result within one week.

The petitioner, who failed Chemistry in the Class XII exams in 2025, had submitted the requisite fee and receipt for the improvement exam to the school. However, the school never sent his form to CBSE, resulting in his being barred from the exam. Following the Court’s interim order, he was allowed to appear, but his result was withheld pending the case.

CBSE’s counsel submitted that three reminders were sent to the school to forward the form, but no action was taken. The school claimed it was a bona fide mistake without malice and informed the Court it had compensated the petitioner.

Condemning the negligence, the Court observed that such conduct caused harassment and mental agony to the student and unnecessarily dragged CBSE into litigation despite its lack of fault.
