New Criminal Law Amendments in India which includes- The Bharatiya Nyaya Sanhita 2023, The Bharatiya Nagarik Suraksha Sanhita and The Bharatiya Sakshya Adhiniyam, 2023, signify a crucial overhaul of the nearly 150 years old criminal justice system, aiming to address persistent challenges and align with contemporary societal needs. These amendments, borne out of legislative reforms, harbor multifaceted objectives geared towards fortifying the justice system’s efficacy, equity, and responsiveness to evolving crime dynamics.
Primarily, the amendments accentuate a robust stance against crimes targeting vulnerable groups, notably women and children. Strengthening penalties for offenses like rape, sexual assault, and child abuse underscores a resolute commitment to safeguarding their rights and dignity. Concurrently, measures to expedite investigation and trial processes with involvement of technology in such cases signal a concerted effort to ensure swift justice delivery and deterrence.
Additionally, the amendments with the involvement of technology want to make Indian justice system at par with the International standards. However, the New Criminal Justice Reforms are going to face obstacles and implementation challenges. Therefore, at this juncture, an analysis of the New Criminal Law Reforms in India becomes necessary to understand the current condition of the Criminal Justice System and how this major shift is going the impact the society and its structure.
