On Wednesday, the Supreme Court took the pleas opposing resumption of Physical Hearings in the Delhi High Court.
The High Court via its order dated 14-01-2021 instructed its Subordinate Courts to prepare Roster initiating Physical Courts on alternate day basis on which some Lawyers took objection and went to Supreme Courtagaruing that it is violation of fundmental rights and health hazard ignorance. Two different petitions were filed in Supreme Court
During the hearing today, Senior Advocate appearing for one of the petitioner informed the Top Court that a meeting has been arranged with the Registrar General of the Delhi High Court.
To this, CJI SA Bobde said that the Court would dispose of the matter, and thereafter the petitioners could move to the Delhi High Court. At this juncture, Sibal sought liberty to approach the Top Court again if required which CJI denied to grant.
"No no no, you are not welcome here again. Thank God you mentioned this (meeting with Registrar General)."
Even as Senior Advocate Geeta Luthra sought permission to be heard tomorrow, CJI Bobde shown trust in the prudence of Chief Justice of Delhi High Court and rejected the request.
"We trust the Chief Justice of Delhi High Court will take a proper decision."
On being asked about the resumption of the Physical Courts and problems of Bar due to the closure of Courts, CJI replied:
"We also want to come to back to action like we did before. But not without medical opinion on board. We know the problems of the Bar. We have been meeting them over the past nine months."
The Court witness a brief heated moment when SG Tushar Mehta took exception of Senior Advocate Vikas Singh's submission that Citizens are being denied justice. Singh shot back at SG with comment that Commeners can't afford expensive Lawyers.
At the end, the Court disposed off the petitons.
The Delhi High Court via its Notice issued dated 14-01-2021 had directed to its Subordinate Courts to prepare Roster allowing Physical Hearings on alternate days.
