In a significant development aimed at enhancing the composition of the Telangana High Court, the Supreme Court has recommended the transfer of Justice Judge P Sam Koshy from the Chhattisgarh High Court.
The proposal, submitted by Justice Koshy himself, was considered by the SC Collegium led by Chief Justice of India Dhananjaya Y Chandrachud, which endorsed the transfer.
Initially, Justice Koshy had sought a transfer out of Chhattisgarh, prompting the Collegium to propose his transfer to the High Court of Madhya Pradesh. However, in a subsequent request, Justice Koshy expressed his preference for a transfer to any High Court other than Madhya Pradesh. Considering his revised request, the Collegium reevaluated the situation and ultimately recommended his transfer to the Telangana High Court.
The decision to transfer Justice Koshy to Telangana is seen as an opportunity to enrich the composition of the state's high court. The Supreme Court's Collegium, responsible for judicial appointments and transfers, carefully considered Justice Koshy's request and concluded that his transfer would be beneficial for both the Chhattisgarh and Telangana High Courts.
It is expected that Justice Koshy's expertise and experience will contribute to the Telangana High Court's functioning and further strengthen its judicial proceedings.
While the transfer recommendation has been made, it is subject to approval by the President of India, who acts on the advice of the Supreme Court's Collegium. Once the necessary approvals are obtained, Justice Koshy will assume his new role in the Telangana High Court.
The transfer of judges between high courts is a routine practice aimed at promoting a diverse and inclusive judiciary. It allows for the exchange of knowledge, experience, and perspectives, fostering a collaborative environment among the judiciary across different states. The transfer of Justice Koshy to Telangana is expected to facilitate the exchange of legal expertise and contribute to the overall improvement of the judicial system.
