A private band company is going to face the music for failing to send a group of musicians for the wedding of a Burail resident. Krishna Band, Sector 24 B, has been directed to pay Rs 30,000 as fine for its forgetful act that gave tense moments to members of a baraat desperately waiting to show their dancing skills.

The case reached District Consumer Disputes Redressal Forum (DCDRF) after Lalit Kumar lodged a complaint, claiming he had booked the band on Jan 29, 2018, for his wedding on Feb.18, 2018. The deal was finalized for Rs 14,000. A sum of Rs 5,000 was paid in advance through Paytm. The band was supposed to perform at 3 venues — house number 104, Yog Vihar, Baltana, a temple & at RA Farm House, Nayagaon, according to Lalit.

Despite several calls, the company didn't send the band, Lalit said. His family members & guests waited from 5.30pm till 9pm & were forced to arrange another band at 10.30pm at Rs 32,000, he claimed.

Krishan Kumar & Ravinder Kumar, both partners at Krishna Band, refuted the charges. They said the complainant didn't remind them for providing the services on the date of the marriage. They said Ravinder had told the complainant over phone around 6.30pm that the band would be able to reach by 7pm because of traffic restrictions owing to a very important person (VIP) visit in the city. When the band reached the house around 7.15pm, another group was present,” the company said.

The company said the complainant had hired another local band from his locality, wasn't keen on availing their services as the team had reached an hour late, claiming a false story was concocted to cause losses to them.

The forum concluded it wasn't convinced with the defence. “They forgot to render the band service committed in advance against a token amount of Rs 5,000. The band admittedly reached late at the residence of the complainant on the special occasion. It was only due to the circumstances that emerged out of the deficient/negligent act of the band that the complainant was forced to engage another band. Due to such negligent act, the complainant & his family members & guests present at the marriage had to undergo mental agony, harassment & humiliation.”

The forum said for inconvenience suffered by the complainant as well as humiliation in the presence of a huge gathering, the complainant needs to be adequately compensated. Krishna Band was then directed to pay up & refund Rs 5,000.
