The Delhi High Court has granted interim relief to actor Akkineni Naga Chaitanya in a suit alleging unauthorised exploitation of his identity across digital platforms. Taking note of allegations involving pornographic content, unauthorised merchandise, AI-generated material and online misuse of the actor's name and likeness, the Court directed action against the infringing content while initiating proceedings in the matter.
The actor approached the High Court alleging that various websites, online platforms and intermediaries were commercially exploiting his name, image and identity without consent. According to the suit, several pornographic websites were allegedly using combinations of his name with sexually explicit terms to drive online traffic, while unauthorised merchandise bearing his name and likeness was being sold through digital platforms.
The suit also raised concerns regarding AI-generated and manipulated content as well as videos and posts relating to the actor's personal life. Seeking protection of his personality rights, the actor sought relief against website operators, hosting entities, e-commerce platforms and intermediaries, including major online service providers. The plaintiff further sought a dynamic injunction, contending that new infringing links and websites continued to emerge even after earlier content was removed.
Justice Jyoti Singh observed that issues relating to personality rights, AI-generated content and allegedly defamatory material may involve distinct legal considerations, particularly when public figures are concerned. The Court was informed that certain infringing merchandise listings had already been removed following legal notices, though references and links remained accessible online. The Court granted interim protection to the actor and directed the concerned defendants to respond, while considering the request for broader protection against recurring infringing content.
