A division bench of Justice Vipin Sanghi and Manoj Kumar Tiwari of Uttarakhand HC disposed of the writ petition seeking protection to them and their property from the alleged threats by taking on record the statements of respondent no. 4 and 5 that they will not interfere in any manner in the peaceful living of the petitioners.
The court further directed to keep an eye on the welfare of the petitioners, and redress their grievance, if any, raised by them from time to time.
Facts:
The present writ petition filed by the husband and wife seeking direction to the respondent authorities i.e. SSP, Haridwar and SHO, PS Kotwali, Jwalapur, Haridwar to provide protection to them and their property from the alleged threats being issued by the respondent nos. 4 and 5, who are the son and the son-in-law of the petitioners.
In the Court, learned State Counsel submitted a report, sent by the Inspector Incharge, Kotwali Jwalapur, Haridwar to the Joint Director (Law), O/o Advocate General, Nainital. The said report discloses that the petitioners had requested that the police should not visit their residence and in case they have any problem, they would themselves report the matter to the police.
Learned Counsel, who appears for the respondent nos. 4 and 5, stated that they had not issued any threat or coercion to the petitioners. Learned Counsel undertakes on behalf of the said respondents that the said respondents will not interfere with the property of the petitioners or their peaceful living and shall not issue any threat to them or cause any harm to them.
Observations of the Court
The court observed from the aforesaid report that petitioners have grievance that their son-in-law has brainwashed their son, who is not acting on their directions and the dispute is a family dispute. The statement of the respondent nos. 4 and 5, made through their Counsel, was taken on record and in the light of the undertaking given on behalf of respondent nos. 4 and 5, the writ petition was disposed of. They further directed the SHO, PS Kotwali, Jwalapur, Haridwar to direct the beat constable of the area to keep an eye on the welfare of the petitioners, and redress their grievance, if any, raised by them from time to time.
Decision:
The present writ petition for seeking police protection against the threats by the son and son-in-law was disposed of in view of the undertaking given by their counsel that they will not interfere in any manner in the peaceful living of the petitioners.
