On Friday, the Delhi High Court granted three day’s interim bail to Delhi riots conspiracy case accused Umar Khalid to enable him to visit his mother during her medical surgery. While permitting temporary release, the Court imposed strict movement restrictions, making it clear that Khalid would remain confined to the National Capital Region and could visit only the hospital and no other location.

The matter reached the High Court after Khalid challenged a sessions court order dated May 19 rejecting his request for interim bail. He had sought temporary release for fifteen days to attend to his ailing mother and also participate in the Chehlum ritual of his uncle, who passed away last month. Opposing the plea, Additional Solicitor General SV Raju argued that the surgery appeared minor and submitted that Khalid could instead be escorted to the hospital by police for a limited duration. The Bench questioned the nature of the medical procedure and sought supporting documents, following which Khalid’s counsel, Senior Advocate Trideep Pais, informed the Court that the surgery related to a cyst on his mother’s back.

The Division Bench of Justice Prathiba M Singh and Justice Madhu Jain balanced the humanitarian grounds raised by Khalid with the prosecution’s concerns by imposing stringent conditions on the interim relief. The Court directed that Khalid furnish a surety of ₹1 lakh and restricted him from travelling beyond the National Capital Region. Emphasising the limited scope of the relief, the Bench observed, “He shall not be allowed to visit any other location other than the hospital.” The Court also directed that Khalid maintain only one mobile number during the interim bail period.

Consequently, the High Court granted him interim bail for three days.
