The Delhi High Court has issued a significant directive to the Delhi Government and educational institutions, emphasizing the need to follow the Rights of Persons with Disabilities Act, 2016, which mandates a 5% reservation for disabled candidates in all educational institutions.

The Bench, comprising Chief Justice Satish Chandra Sharma and Justice Saurabh Banerjee, has specifically instructed Guru Gobind Singh Indraprastha University to implement the 5% reservation for specially-abled individuals in accordance with the law.

The court's decision came in response to a public interest litigation (PIL) filed by the non-governmental organization Justice For All. The PIL alleged that the university had failed to provide the prescribed 5% reservation for specially-abled candidates as required by the Act.

In its recent order, the court directed both the Delhi Government and the university to make every possible effort to ensure that the seats meant for specially-abled persons are filled by providing reservations to all categories of specially-abled candidates.

The court further stated, "The university, as well as the State Government, are directed to ensure that in all educational institutions, the statutory provisions governing the field under the RPWD Act are followed and 5 per cent reservation is provided to specially-abled persons."

Earlier, in May, the Delhi High Court had issued an interim order instructing the university to implement reservations for disabled candidates in the current academic session. The petitioner had raised concerns that the university was only providing a 3% quota instead of the mandated 5%. In response to the interim order, the university filed an affidavit, assuring the court that it was adhering to the 5% reservation policy.

While the court acknowledged that the university had indeed been providing the 5% reservation, it stressed the importance of compliance with the statutory provisions of the RPWD Act across all educational institutions.
