The Office of Career Services of Jindal Global Law School as part of its corporate outreach initiative, invited to the OP Jindal Global University on August 29, 2018 on “Arbitration & its Best International Practices”.The speakers engaged students in the intricacies and nuances of Arbitration, nationally and internationally. Mr. Harman shared personal insights comparing the practice of arbitration in India & abroad, based on his 43 years long career in practicing Alternate Dispute Resolution.

The event was structured as an interactive session where Link Legal representatives interacted with students by sharing their stories from their legal practice to emphasize the importance of a well drafted contract and specifically an arbitration clause.

The speakers also talked about the importance of checking the enforceability of such arbitration clause in various jurisdictions before incorporating it.

The intent of having an arbitration clause in any agreement is to eventually have a speedier and inexpensive dispute resolution. Hence, a lawyer’s work includes attention to detail and foreseeing contingencies at the outset.

Through the session the students got an understanding of why arbitration is encouraged over litigation.

The audience consisted of senior batch students of JGLS seeking advice on making career choices upon graduation and addressing questions to the speakers on ‘Careers in Arbitration’.

Speakers responded by emphasizing the importance of familiarizing oneself with various aspects of the law & practice of arbitration and also impressed upon the students an urgent need for young law students to aspire to be authentic lawyers and bring competency to the table.

On questions of specialization, they focused on having an open approach upon joining the profession and further specializing according to interests developed during work.

Arbitration as a concept, though prevalent since 1940 is still at its formative stage in India.

The discussion brought forth the finer points of the law pertaining to arbitration, novel concepts on what function arbitration as an alternative dispute resolution method serves, various intricacies of the convoluted structure of an arbitral process and the jurisdiction of Civil Courts.

Also, the recent amendments in the Indian Arbitration Act and their impact on commercial contracts were discussed.The amendments, as informed, have also imbibed some of the international best practices in arbitration.

They ended with a discussion of the recent trends in India paving the way towards better Arbitral Governance in India and recognition of foreign awards in India.

Various opinions were shared on how arbitration has developed in India over time and how India must strive to have a domain specific arbitration cell.

The corporate dialogue paves the way for Jindal Global Law School and Link Legal to take forwards their relationship and to continue holding such sessions on relevant topics.
