3. By means of present writ petition, petitioner has challenged the recovery order dated 15.09.2025 passed by Assistant Regional Transport Officer (Administration), Rishikesh, District Dehradun, whereby the District Magistrate, Dehradun was requested to issue recovery citation to recover the amount of Rs.1,55,828/- by way of land revenue.

It is contended by learned counsel for the petitioner that the petitioner has never been issued any demand/ notice by the respondent-department; straightaway, this order dated 15.09.2025 was issued to the District Magistrate, Dehradun, a copy of which was addressed to the petitioner, owner of the vehicle. He further contends that the aforesaid amount is commercial tax allegedly to be paid by the petitioner during the period of 2015-2025.
5. Learned State Counsel shall seek instructions in the matter from the respondent-department as to whether any notice/demand was ever sent to the petitioner for the payment of the aforesaid tax due against her to recover the amount of tax.
