Mr. Mohd. Safdar, learned counsel for the petitioner.
2. Mr. Yogesh Pandey, learned D.A.G. for the State/respondent nos.1 to 3.
3. Mr. Mujahid Hassan, learned counsel holding brief of Mr. Rajveer Singh, learned counsel for respondent nos.4 and 5.
4. This Court vide order dated 24.03.2026 directed the State counsel to submit a report that as to whether the public path leading to the house of the petitioner being encroached upon by the private respondents or not.
5. A report submitted by learned counsel for the State dated 27.03.2026 under the hand of In-charge Inspector, Kotwali- Roorkee. In the said report it has been specifically mentioned that there is no encroachment in Gali No.15 leading to the house of the petitioner which according to the report is 9-10 feet wide.
6. It is further submitted in the report that Gali No.12 is also 16 feet wide and there is no such encroachment over the Gali No.12. Rather on the west side of the land purchased by the petitioner there is dead end and the adjacent plot is of one Mr. Pundir.
7. S.H.O. concerned is directed to file an affidavit regarding the aforesaid fact.
8. List this case on 09.04.2026.
