2. Mr. Anil Kumar Joshi, learned counsel holding brief of Mr. Pradeep Joshi, learned counsel for respondent Nos.1 and 2.
3. Ms. Payal Bhatia, learned counsel holding brief of Mr. Aman Rab, learned counsel for respondent No.3, appeared through V.C.
4. During course of arguments, it transpires that the matter relates to handing over the possession of flats constructed by petitioner-builder to respondent Nos.1 and 2.
5. The stand of the petitioner is that the respondent Nos.1 and 2 themselves failed to make the payment of instalment in year 2017 to petitioner-builder, which resulted into delay in handing over the flats. Respondent Nos.1 and 2 admittedly paid instalments in the year 2020, which was delayed one and also made a request of handing over the possession of flats to them.
6. It appears that this matter can be settled amicably among the parties, if the matter is sent to Mediator/Counsellor of the High Court.
7. In order to settle the dispute amicably, responsible representative of petitioner- builder and respondent Nos.1 and 2 are directed to appear before the Mediator/ Counsellor in the High Court Mediation Centre on 08.04.2026 at 11:00 AM. The Mediator/Counsellor shall however endeavour to settle the dispute amicably among the parties and thereafter submit its report.
8. Put up on 28.05.2026 along with the report of Mediator/Counsellor.
9. Interim order dated 12.01.2024 is extended till then.
