2. Since the issue involved in both the writ petitions is identical, therefore, these are being heard and decided together by this common judgment. However, for brevity, facts of Writ Petition (S/S) No. 916 of 2026 alone are being considered and discussed here.

3. Petitioner retired from Uttarakhand Transport Corporation on 31.7.2025. On 23.7.2025, Assistant General Manager, Kathgodam Depot passed an order directing that a sum of ₹1,60,500 shall be recovered from the amount payable as gratuity to the petitioner. Thus, feeling aggrieved, petitioner has approached this Court.

4. Learned Counsel for the petitioners submits that the issue involved here is identical to the one decided by Division Bench of this Court in SPA No. 245 of 2022. He submits that these writ petitions also deserve to be decided in terms of the judgment rendered in the said Special Appeal.

5. Mr. N.S. Pundir, learned Counsel appearing for Uttarakhand Transport Corporation, submits that due to wrong fixation of pay, excess amount was released to petitioner, which deserves to be recovered from him. He, however, concedes that the issue involved in the present writ petitions is identical to the one decided by Division Bench of this Court in SPA No. 245 of 2022 and 2026:UHC:2236 submits that these writ petitions can be decided in terms of judgment rendered in SPA No. 245 of 2022.

6. Accordingly, both the writ petitions are decided in terms of judgment dated 4.4.2024, rendered in SPA No. 245 of 2022.
