Mr. Narendra Bali, learned counsel for the petitioner.

2. Mr. Devendra Pant, learned B.H. for the State.

3. Mr. Raunak Pant, learned counsel holding brief of Mr. Naresh Pant, learned counsel for N.H.A.I/respondent no.2.

4. The petitioners are before this Court for payment of compensation for the extra land comprised in Khasra No.13 ad-measuring 0.0800 hectare, which was taken in possession by the respondent-N.H.A.I. for construction of N.H. 125 passing through Jangal Jogither, Sitarganj.

5. It is admitted by counsel for the respondent- N.H.A.I. that the land of the petitioner other than above one has already been acquired and after taking possession thereof, compensation has been paid.

6. He further admits that this land is also taken in possession by the respondent-N.H.A.I. and the N.H.A.I. is ready to make payment of the said land as per law after completing all the formalities.

7. Since the controversy involved in the present writ petition in substance has been admitted by the respondent-N.H.A.I., both the respondents are directed to proceed, in accordance with law, for acquisition of the extra land which has been taken in possession by the petitioner during the construction of the N.H.125.

8. The exercise shall be conducted by respondents within a period of three months from today, in accordance with law.

9. Accordingly writ petition stands disposed of.
