Hon'ble Manoj Kumar Tiwari, J.
Ms. Aashna Parashar, Advocate, holding brief of Ms. Priyanka Agrawal, Advocate for the petitioner.
2. Mr. S.S. Chaudhary, Standing Counsel for the State of Uttarakhand.
3. Mr. Sandeep Kothari, Advocate for respondent nos. 2 and 3.
4. Mr. Rajendra Arya, Advocate, holding brief of Mr. Neeraj Garg, Advocate for respondent no. 4.
5. Petitioner was engaged on contract as Assistant Librarian in a campus college of Uttarakhand Ayurved University in the year 2015. Her engagement was not extended beyond March, 2018. Thus, feeling aggrieved, petitioner has filed this writ petition in 2019, seeking the following reliefs:-
"i) Issue a writ, order or direction in the nature of mandamus directing the respondent nos. 2 & 3 to allow her to re-join on her post of 'Pustkalaya Prabhari- (Officer Cadre)', with immediate effect.
ii) Issue a writ, order or direction in the nature of mandamus directing the respondent nos. 2 & 3 to regularize the services of the petitioner in accordance with law.
iii) Issue a writ, order or direction in the nature of mandamus directing the respondent nos. 2 & 3 to release her salary since 01.01.2018, and also, direct them to pay her the interest @ 18% per annum upto the date of final payment, on the amount due to them."
2026:UHC:2206
6. Petitioner has also staked claim regarding unpaid salary since 1.1.2018.
7. Learned counsel appearing for the University on instructions submits that remuneration was released in favour of the petitioner in the year 2018 and whatever balance amount remained to be paid was paid on 01.05.2025.
8. Learned counsel for the petitioner submits that since work and post is available, therefore, petitioner has a right to be re-engaged as Assistant Librarian.
9. Learned counsel for the University, however, disputes this submission and contends that post is not available in the University.
10. Having regard to the facts and circumstances of the case, this Court thinks that ends of justice would be met if petitioner is permitted to make representation.
11. The writ petition is, accordingly, disposed of by permitting the petitioner to make representation regarding her re- engagement. It shall also be open to the petitioner to raise other grievances in that representation. If such representation is submitted within two weeks from today, decision thereupon shall be taken by the Registrar of the University, within six weeks thereafter.
