On 25.06.2018, the writ petition (WPMS No.3025 of 2017) was dismissed for want of prosecution.
2. The proposed legal representatives have filed a restoration application along with delay Condonation application and since the original petitioner passed away, therefore, a delay condonation application in setting aside abatement application, delay condonation application in substitution application have also been filed by the proposed legal representatives of the deceased petitioner.
3. Heard Mr. B. S. Adhikari, learned counsel for the petitioner and Mr. Neeraj Garg, learned counsel for the respondent nos.1 to 4.
4. The delay condonation application, setting aside abatement application and substitution application have not been opposed by the respondents.
5. In the interest of justice, the delay is condoned.
6. Mr. B.S. Adhikari, Advocate, has sought one week's time to file an amended memo of restoration application and delay condonation application.
7. Notice is being issued to the respondent no.5 Tej Prakesh Kohli and the respondent no.6 Raju Balmiki. Steps to be taken by all the permissible modes within a week.
8. The Setting Aside Abatement Application (CLMA No.16273 of 2018), Delay Condonation Application in Setting Aside Abatement Application (CLMA No.16299 of 2018), Delay Condonation Application in Substitution (CLMA No.16277 of 2018) and Substitution Application (CLMA No.16276 of 2018) are disposed of accordingly.
9. List on 21.05.2026 for hearing on the Delay Condonation Application (CLMA No.16272 of 2018) and the Restoration Application (MCC No.1367 of 2018).
