1. Mr. Saurabh Kumar Pandey, learned counsel for the revisionist.
2. Mr. G.S. Sandhu, learned Addl. Advocate General with Ms. Rangoli Purohit, learned Brief Holder for the State.
3. The instant criminal revision has been preferred against the judgment and order passed by the trial court dated 21.11.2019 as well as by the Appellate Court dated 02.12.2025, whereby the learned Appellate Court has partially allowed the appeal and convicted the revisionist under Section 406 of IPC and sentenced him to undergo 2 years rigorous imprisonment and fine of Rs. 10,000/-
3. As per the office report the revision is well within time.

5. Summon the trial court record 6. On exemption application (IA No. 1 of 2026) it is contended by the learned counsel for the revisionist that revisionist is serving in a private company and if he surrenders there may be a possibility that he may be removed from the job. Apart from this he submits that maximum sentence awarded by the Appellate Court is 2 years R.I. with the fine of Rs. 10,000/-.
7. Mr. G.S. Sandhu, learned Addl. Advocate General have not raised any objection on exemption application.
8. In such view of the matter, the exemption application is allowed and fine and sentence as awarded by the court below shall remain suspended during the pendency of the instant revision.
9. List this revision on 25.05.2026 along with CRLR No. 158 of 2026 for final hearing.
