Mr. Pradeep Chamyal, learned counsel for the Appellant.
2. Mr. Vipul Painuly, learned AGA with Mr. Chitrarth Kandpal, learned Brief Holder for the State of Uttarakhand.
3. As per office report, the service is said to be secondary on the basis of report furnished by the learned CJM, Nainital. Further it is reported that Respondent No.2 Mr. Arvind Bharti S/o Late Rambharose, is working in Nagar Palika Parishad, Nainital, District Nainital was served at a given address by Constable Sri Vijendra Dhami in the office, and it is reported that Shri Arvind Bharti, is not attending the office. Considering the same, the service is considered to be sufficient
4. Since observations of this Court as per the service report, service is considered to be sufficient, but still in the interest of justice, a time may be accorded for the Respondent No.2 to represent in person or through the learned counsel before this Court.
5. Trial Court Record has been received and the paper-book has also been prepared, but not furnished to the parties.
6. Let the paper-book be furnished to the learned counsel for the parties on the payment of usual charges.
7. List this matter on 16.04.2026.
