2. Mr. S.S. Chauhan, learned Deputy Advocate General assisted by Mr. Pramod Tiwari, learned A.G.A. and Mr. Vikash Uniyal, learned A.G.A. for the State of Uttarakhand.

3. The present Bail Application has been moved by the Applicant-Paramjeet Singh @ Digambar. The Applicant is in judicial custody in connection with FIR No. 0040 of 2025, registered at Police Station Chamba, District Tehri Garhwal, for the offences punishable under Sections 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as the "NDPS Act").

4. Learned counsel for the Applicant submits that the Applicant has been falsely implicated in the present matter and that there are material irregularities in the mandatory procedure required to be followed with respect to the arrest and seizure.

5. It is further submitted that the alleged recovery of 1 kg 300 grams of contraband charas, stated to be in the form of sticks as per the recovery memo, is doubtful, and the procedure relating to proper sampling has not been duly followed in accordance with law.

6. Learned State Counsel seeks time to file objections.

7. Let objections, if any, be filed by the State.
