1. Mr. Mukesh Singh Rawat, learned counsel for the petitioner.
2. Mr. S.S. Chauhan, learned counsel for the respondent-Uttarakhand Transport Corporation.
3. Petitioner is aggrieved by order dated 05.12.2024, whereby he was terminated from service by Assistant General Manager, Uttarakhand Transport Corporation, Dehradun. It is contended that petitioner has been terminated from service without holding any formal disciplinary enquiry as required under Section 13(3)(1) of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
4. It is contended that a complaint was made against petitioner under provisions of aforesaid Act on which an enquiry was made in terms of Section 11 of the Act and thereafter without issuing a charge-sheet, petitioner was terminated from service. Thus, he submits that principals of natural justice were violated and provisions of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 was not followed.
4. Let counter affidavit be filed within four weeks.
5. List this case on 18.05.2026.
6. Till the next date of listing, effect and operation of the impugned order dated 05.12.2024 shall remain stayed.
7. Interim relief application (IA No. 1 of 2026) stands disposed of.
