Heard Mr. S.K. Mandal, learned counsel for the petitioners and Mr. K.S. Mehta, learned Additional Chief Standing Counsel & Mr. Ghanshyam Joshi, learned Additional Chief Standing Counsel for the respondent no.1.

2. Mr. S.K. Mandal, Advocate, for the petitioners submitted that a lease was granted to the father of the petitioners under the provisions of Government Grants Act, 1895. Subsequently, the father of the petitioners, namely Joginder Singh, was granted the status of bhumidhari with non-transferrable rights under "shreni 1 kha" from 1384 fasli. Therefore, the land in-question cannot be vested in the State Government by cancelling the lease granted to Sri Joginder Singh, as directed by the learned Collector, Udham Singh Nagar vide impugned order dated 05.10.2023, passed in Case No.51/12 of the year, 2014-15, "State vs. Joginder Singh and Others". The petitioners' father has passed away. The petitioners are still in possession of the property in- question.

3. Mr. Ghanshyam Joshi, Additional Chief Standing Counsel, on instructions, has sought four weeks' time to file counter affidavit.

4. Notice is being issued to the private respondents. Steps to be taken within a week by all the permissible modes.

5. List on 11.05.2026. Till then, the parties are directed to maintain status quo regarding the possession of the property-in-question.
