1. Heard learned counsel for the parties.
2. The present writ petition has been filed praying for a writ of mandamus commanding respondent no.4 - Uttarakhand Pollution Control Board to decide petitioner's application dated 09.03.2026 for grant of Consent to Operate/Consent to Establish a stone crusher unit at Village Bhankoli, Tehsil Purola, District Uttarkashi.
3. The case of the petitioner is that earlier the business was being done in the name of a partnership firm; subsequently, the Mining Department, on basis of application filed by the petitioner, granted permission for 1 2026:UHC:2024-DB conversion of partnership firm into proprietorship firm of the petitioner and also for transfer of the crusher unit to the petitioner. Copy of the said order dated 03.02.2026 has been annexed as Annexure-7. It is submitted that thereafter the petitioner applied for Consent to Operate/Consent to Establish the stone crusher unit in his own name but the application is still pending and hence the present writ petition.
4. Learned counsel appearing on behalf of Uttarakhand Pollution Control Board very fairly states that the application shall be decided expeditiously.
5. Accordingly, the writ petition is disposed of with direction to respondent nos.3 and 4 to decide the application dated 09.03.2026 expeditiously, preferably within eight weeks from the date of communication of the instant order along with copy of the application, provided there is no legal impediment.
6. Pending application(s), if any, shall also stand disposed of accordingly.
