Mr. Gyanendra Kumar Sharma, learned counsel for the petitioner- applicant.
2. Mr. Rajendra Dobhal, learned Senior Advocate assisted by Mr. Shubhang Dobhal, learned counsel for the respondent no.1.
3. On 12.02.2026, the petitioner and the respondent no.1 were directed to appear before this Court. A Modification Application (MCC No. 9542 of 2026) has been filed by the respondent no.1.
4. As per the Modification Application, the respondent no.1 is religious Head and tenth Sajjade Gaddi Nashin of Shri Guru Ram Rai Darbar Sahib, Jhanda Mohala, Dehradun and as per the customs of Shri Darbar Sahib and by virtue of the Gaddi Nashin, the respondent no.1 has to give darshan to the devotees visiting from all over North India at Darbar Sahib, Dehradun every morning as a result, the presence of the respondent no.1 is necessary at Darbar Sahib, Dehradun. The respondent no.1 has executed a Special Power of Attorney deed in favour of Vijay Gulati.
5. The Special Power of Attorney deed has been annexed with the Modification Application.
6. The Petitioner-applicant Mr. Pradeep Kumar Saini is present.
7. Mr. Vijay Gulati is present.
8. Both the parties submitted that settlement is not possible.
9. Mr. Rajendra Dobhal, Senior Advocate, has sought ten days' time to file objection to the Restoration Application (MCC No.9537 of 2024).
10. In the interest of justice, time is granted.
11. List on 30.04.2026 for hearing of the Restoration Application (MCC No. 9537 of 2024).
12. The Modification Application (MCC No. 9542 of 2026) is disposed of accordingly.
