2. Mr. Sudhir Nailwal, learned Standing Counsel with Mr. K.S. Mehta, learned Addl. C.S.C. for the respondent no.1.

4. Mr. S.K. Mandal, Advocate submitted that the construction cost was assumed Rs.56,78,880=00. On 10.12.2025, the respondent no.1, against the provisions of law, directed the petitioners to deposit the remaining amount Rs.45,10,926=00. An appeal (Appeal No.3 of 2026) was filed by the petitioners. The said appeal has been dismissed by the Labour Commissioner on 09.03.2026. Hence, the present writ petition under Article 227 of the Constitution of India.
5. Learned counsel for the respondents have sought four weeks' time to file their counter affidavits.
6. Mr. S.K. Mandal, Advocate has requested to stay the said order dated 10.12.2025. He submitted that a sum of Rs.11,67,954/- has already been deposited by the petitioners before the respondent no.2 and the petitioners undertake that they shall deposit 50% of the total amount (total amount Rs.56,78,880=00) minus Rs. 11,67,954=00 (i.e. Rs. 16,71,486=00) before the respondent no.2 within four weeks from today.
7. On the joint request, list on 09.06.2026.
8. Subject to deposit of Rs.16,71,486=00 by the petitioners before the respondent no.2 within four weeks from today, the effect and operation of the impugned order dated 10.12.2025 are kept in abeyance till the next date of listing.
9. Stay Application (IA No.1 of 2026) stands disposed of accordingly.
