Learned Tehsildar, Bazpur, District Udham Singh Nagar closed the opportunity of the petitioner
- opposite party to adduce evidence vide order dated 18.01.2020 in Case No.30/1080 of the year, 2018-2019, filed under Section 34 of the Uttar Pradesh Land Revenue Act, 1901 (as applicable in the State of Uttarakhand). A Revision (No.72 (2020-21)/35 (2019-20), "Devendra Singh vs. Rajdeep Singh and Others") was filed. The said Revision has been dismissed vide judgment dated 20.12.2021, passed by learned Commissioner, Kumaon Mandal, Nainital. Hence, the present writ 1 2026:UHC:1932 petition under Article 227 of the Constitution of India.
2. Heard Mr. Vikas Kumar Guglani, learned counsel for the petitioner and Mr. Deepak Bhatt, learned counsel for the respondents.
3. Mr. Vikas Kumar Guglani, Advocate, has requested on instructions to dispose of the present writ petition directing the Tehsildar, Bazpur to decide the said Case No.30/1080, filed under Section 34 of the Uttar Pradesh Land Revenue Act, 1901, within three months.
4. The said request has not been opposed by the respondents.
5. On the request of both the parties, the order dated 18.01.2020, passed by learned Tehsildar, Bazpur, and, the judgment dated 20.12.2021, passed by learned Commissioner, Kumaon Division, Nainital are set aside. Learned Tehsildar, Bazpur is directed to decide the Case No.30/1080, filed under Section 34 of the Uttar Pradesh Land Revenue Act, 1901, as expeditiously as possible, as per law, but not later than three months from the date of presentation of the 2 2026:UHC:1932 certified copy of this order.
6. The present Writ Petition [No.568 of 2022 (M/S)] is disposed of accordingly.
7. It is made clear that this Court has not expressed any opinion on the merit of the case.
