Instant appeal is preferred against judgment and award dated 04.05.2024, passed in Motor Accident Case No. 146 of 2022, Smt. Tabassum Parveen and others Vs. Bajaj Allianz General Insurance Company Ltd. and others, by the Motor Accident Claims Tribunal/2nd Additional District Judge, Haldwani, District Nainital.
Now, the respondent nos. 1 to 5/claimants have filed a Money Withdrawal Application No. 03 of 2026 on the ground that the respondent no.5 is suffering with cancer and it has become little difficult for the respondent no.1/the wife of the deceased to run the family. She has taken gold loan also.
Learned counsel for the appellant submits that the Rs.50,00,000/- Lakh has already been deposited, out of which, Rs. 8,50,000/- has already been paid.
Having considered the grounds taken for withdrawal of money, this Court directs that out of, the deposited amount i.e. Rs.50 Lakh, let Rs.10,00,000/ Lakh be released in favour of the respondents in proportion to their respective shares as per award. The amount shall be transmitted in the accounts of the respondents directly.
List on 21.05.2026 for final hearing alongwith connected matters.
Money withdrawal application is decided accordingly.
