2. Mr. S.S. Chauhan, learned Deputy Advocate General assisted by Mr. Vikash Uniyal, learned Brief Holder for the State of Uttarakhand.
3. The present Bail Application has been moved by the Applicant- Azad Miya, aged about 22 years, S/o Shri Nasir Miya, R/o Rajeev Nagar, Boring Patti, Bindukhatta, Lalkuan, District Nainital. The Applicant is in judicial custody in connection with FIR No. 191 of 2025, registered at Police Station Lalkuan, District Nainital, for the offences under Sections 64, 137(1)(b), and 137(2) of the B.N.S., 2023, and under Sections 3/4 of the POCSO Act.
4. The main allegation against the Applicant is that he enticed a minor girl, stated to be about 13 years of age.
5. Learned counsel for the Applicant submits that, according to the statement of the minor victim, she had left her house on her own. It is contended that the Applicant has been falsely implicated in the present matter. It is further submitted that the minor girl returned home the next day.
6. Learned State Counsel prays for, and is granted, three weeks' time to file objections to the bail application.
