This writ petition has been filed under Article 227 of the Constitution of India with the following prayers :-
"(i) Issue an appropriate writ, order, or direction, to the court of Learned Civil Judge (Sr. Div.), Dehradun to expedite the proceedings of the Original Suit no.453 of 2024 "Anil Kumar Batra vs Sushil Kumar Batra & others" presently pending before it within a stipulated time frame as provided by this Hon'ble Court.
(ii) Pass such further orders or directions which this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case.1

(iii) Award the cost of the petition."
2. Heard Mr. Rishab Ranghar, learned counsel for the petitioner.
3. Mr. Rishab Ranghar, learned counsel for the petitioner submitted that the said Original Suit No.453 of 2024, "Anil Kumar Batra vs Sushil Kumar Batra & others", has been filed by the petitioner for declaration and partition. Petitioner is a Senior Citizen aged about 65 years, therefore, his case should be given priority for disposal at the earliest.
4. In the facts and circumstances of the case, the learned trial court is directed to decide the Original Suit No.453 of 2024 expeditiously, as per law, without granting any unnecessary adjournment to either party.
5. The present Writ Petition No.586 of 2026 (M/S) is disposed of accordingly.
6. It is made clear that this Court has not expressed any opinion on the merit of the case.
