This writ petition has been under Article 226 of the Constitution of India, challenging the impugned order dated 17.01.2026, annexure no.1 to the writ petition, whereby the petitioner's husband respondent no.7-Dharmendra Singh s/o Shree Balveer Singh was found in illegal possession of the Government land and consequently the D.P.R.O. was directed to ensure the proceedings against the petitioner, who happens to be Pradhan of Gram Sabha-Bhogpur, P.O.-Badiowala, Tehsil-Jaspur, District-Udham Singh Nagar under Section 8(1)(s) and under Section 138 of the Uttarakhand Panchayati Raj Act, 2016 as well as the show-cause notice dated 21.02.2026 issued by District Magistrate, Udham Singh Nagar.

On the last date, it was argued by learned counsel for the petitioner that though in previous notice dated 24.08.2023, name of the husband of the petitioner was found at Serial No.6 as an unauthorized occupant of the State land, but in the subsequent notice dated 15.10.2025 name of the husband of the petitioner was not found.
7. It was also submitted on that date that the possession of 2 the land which was found in illegal occupation of the various occupants was recovered on 05.03.2026 vide annexure no.11 to the writ petition.
8. Since the document (annexure no.11) whereby the possession was recovered by the State Government was not clear as from whom possession was recovered, this Court directed the State to file an affidavit with requisite documents within a week disclosing therein from whose possession(s) the Government land was recovered.
9. Such an affidavit has not been filed by the petitioner as yet; however, the instructions are produced before this Court.
10. Learned counsel for the respondent(s) are directed to file an affidavit(s) by 23.03.2026.
