2. Mr. Suyash Pant, learned Standing Counsel for the State.

3. By means of the present writ petition, the petitioners have challenged the order dated 04.02.2026 issued by respondent no.2, contained in Annexure-1 to the writ petition, whereby the District Magistrate, Udham Singh Nagar, directed the SDMs of District Udham Singh Nagar to destroy the unauthorized nursery of summer paddy and to allow summer paddy in areas only where there is waterlogging.

It is contended by learned counsel for the petitioners that the petitioners are farmers of Udham Singh Nagar and have their fields in Tehsil Gadarpur; some of the petitioners have their fields in areas other than waterlogged areas. The main question raised by learned counsel for the petitioners for consideration by this Court is as to under which provision of law such an order can be passed by the respondent-District Magistrate, Udham Singh Nagar.

5. The respondents may file counter affidavit within two weeks, specifically stating therein under which 2 provision of law the District Magistrate, Udham Singh Nagar is empowered to pass such an order.

6. However, in order to safeguard the interests of the petitioners and protect their right to sow summer paddy, they are, in the meantime, permitted to grow the nursery of summer paddy.
