2. Mr. Anil Dabral, learned Additional C.S.C. with Mr. Suyash Pant, learned Standing Counsel and Mr. B.S. Koranga, learned Brief Holder for the State of Uttarakhand/respondent No.1.
3. Mr. Vipul Sharma, learned counsel for respondent Nos.2 and 3, appeared through video conferencing.
4. By means of the present writ petition, petitioner has challenged the order No.852 /RM/SIDCUL/2024 dated 26.06.2024, by which respondent No.3 has cancelled the lease for plot No.17 enclosed as Annexure No.3 to the writ petition.
5. It is contended by learned counsel for petitioner that one plot was allotted by respondent- SIDCUL being plot No.20 in the year 2005 and the other plot was allotted to him in the year 2012 being plot No.17. In 2013, both the plots were merged by the respondent-SIDCUL. Petitioner is a pharmaceutical company and by the impugned order, plot No.17 was cancelled for non-utilization and violation of the map, which is factually incorrect.
