Mr. Shashi Kant Shandilya, learned counsel for the Appellant.

2. Mr. S.S. Chauhan, learned DAG, Mr. Pramod Tewari, learned AGA assisted by Mr. Vikash Uniyal, learned Brief Holder, for the State of Uttarakhand.

3. Appellant was convicted for offence punishable under Section 22 (C) of the NDPS Act, vide judgment and order dated 11/28.08.2023, passed by the court of learned Special Judge (NDPS Act), Dehradun in Special Sessions Trial No.54 of 2015, "State Vs. Kanhai @ Kanhaiya @ Kanhi Vishwas". Challenging his conviction and sentence, Appellant has filed this appeal.

4. Learned counsel for the Appellant submits that the Appellant was on bail during the pendency of trial, and has never misused the bail.

5. Considering the overall facts and circumstances of the case, the Appellant has made out a case for bail.

6. Consequently, the bail application is allowed. Let the Appellant/Applicant, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned.

7. List this matter on 25.05.2026.
