Hon'ble Ravindra Maithani, J. (Oral) Instant appeal is preferred against the judgment and order dated 28.02.2017, passed in Session Trial No.127 of 2013, State vs. Shailesh @ Shailendra Rayal & Another, by the court of learned 1st Additional District & Sessions Judge, Rishikesh, District Dehradun. By it, the appellants have been convicted under Sections 302 read with Section 34 and 201 read with Section 34 of IPC and sentenced accordingly. The appellants seek bail in this appeal.
2. Heard learned counsel for the parties and perused the record.
3. At the very outset, learned counsel for the appellants would submit that the appellants have already undergone more than half of the sentences.

4. Learned State counsel admits this fact.
5. Having considered, this Court is of the view that it is a case in which the execution of sentence should be suspended and the appellant be enlarged on bail.
6. The bail applications are allowed.
7. The execution of sentence appealed against is suspended during the pendency of the appeal.
8. The appellants - Shailesh @ Shailendra Rayal and Rajeev Bhatia be released on bail, during the pendency of the appeal, on their executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
