The present Special Leave to Appeal has been filed under Section 419(4) of the B.N.S.S., 2023, seeking leave to appeal against the judgment and order dated 25.02.2026 passed by the learned Judicial Magistrate/2nd Additional Civil Judge (J.D.), Nainital, District Nainital in Criminal Complaint Case No. 347 of 2026, "Janki Bhandari vs. Shri Akhilesh Tamta", arising out of proceedings under Section 138 of the N.I. Act, 1881, whereby the learned trial court has acquitted the Respondent No. 2.
4. Upon hearing learned counsel and on perusal of the record, the matter requires consideration.
5. Let the Trial Court Record be summoned.
6. After receipt of the Trial Court Record, let the paper book be prepared and supplied to the learned counsel for the parties, as per Rules.
